Agreement to Terms

By using the services of RapidCrew Gilroy Towing, you agree to be bound by these Terms of Service. These terms apply to all customers who request towing, roadside assistance, or related services from our company. If you do not agree with any part of these terms, please do not use our services.

Services Provided

RapidCrew Gilroy Towing provides towing and roadside assistance services including but not limited to:

  • Emergency towing
  • Roadside assistance (jump starts, tire changes, lockouts)
  • Flatbed towing
  • Long-distance towing
  • Motorcycle towing
  • Accident recovery and winching
  • Junk car removal
  • Heavy-duty towing

Services are subject to availability. We reserve the right to refuse service if we determine that a job is unsafe or beyond our capabilities.

Pricing and Payment

Pricing for services is based on several factors including distance, vehicle type, time of day, and complexity of the job. We provide estimates over the phone, but final charges may vary based on actual conditions at the scene. Payment is due at the time of service unless other arrangements have been made in advance.

We accept cash, credit cards, and debit cards. If payment is not received, we reserve the right to hold the vehicle until payment is made in full, in accordance with California state law.

Customer Responsibilities

You agree to provide accurate information about your vehicle and location. You must be present or designate an authorized representative to release the vehicle to us. You are responsible for removing all personal belongings from your vehicle before towing. RapidCrew Gilroy Towing is not responsible for items left in vehicles.

You confirm that you are the owner of the vehicle or have the legal authority to request towing services for it. You agree to indemnify and hold harmless RapidCrew Gilroy Towing from any claims arising from unauthorized use of our services.

Limitation of Liability

RapidCrew Gilroy Towing takes great care in handling your vehicle. However, we are not liable for damage to vehicles that results from pre-existing conditions, hidden damage, or circumstances beyond our control. We carry insurance as required by California law, and claims for damage must be reported within 48 hours of service.

Our liability is limited to the actual cash value of the vehicle or the cost to repair the damage, whichever is less. We are not responsible for consequential damages such as lost wages, rental car costs, or other indirect losses.

Cancellations

If you need to cancel your service request, please call us as soon as possible. Cancellations made after our truck has been dispatched may be subject to a cancellation fee to cover our costs. If our driver arrives at the scene and you decide not to use our services, you may be charged a service call fee.

Disputes and Governing Law

These Terms of Service are governed by the laws of the State of California. Any disputes arising from our services will be resolved in the courts of Santa Clara County, California. Both parties agree to attempt to resolve disputes through good faith negotiation before pursuing legal action.

Changes to Terms

RapidCrew Gilroy Towing reserves the right to modify these Terms of Service at any time. Changes will be posted on our website with an updated date. Your continued use of our services after changes are posted constitutes acceptance of the new terms.
